Delhi High Court Fines Woman for False Sexual Offence Claim
The Delhi High Court has imposed a fine of Rs 20,000 on a woman for falsely filing a case of sexual offence against her live-in partner. The decision came from Justice Swarana Kanta Sharma, who also ordered the cancellation of the First Information Report (FIR) against the man accused under Sections 69 and 351(2) of BNS.

In the judgment made on July 15, the court emphasized the serious impact of such allegations not only on the accused but also on the justice system. The court referenced the womanβs claim that she filed the FIR during a period of emotional and medical distress.
The court stated that making accusations under Sections 69 and 351(2) of BNS, involving allegations of physical assault and wrongful restraint, should not be done casually. It is crucial to consider the repercussions as they can significantly affect both the accused and the justice process.

The judge noted that subjecting a person to trial when allegations arise from a misunderstanding could undermine principles of fairness and justice. Continuing criminal proceedings, even if the complainant no longer wishes to pursue them, is deemed as an abuse of the legal process.
Considering the circumstances, the woman was fined for initiating the legal process based on a misunderstanding, despite voluntarily being in a relationship with the petitioner. The court directed her to deposit the fine with the Delhi High Court Legal Services Committee within four weeks.
