Real Estate Developer Barred for Project Delays and Financial Misconduct
The Telangana Real Estate Regulatory Authority (TG RERA) has taken action against a real estate developer for significant project delays and financial irregularities.
Details of the Case
The order issued by TG RERA directed the developer of the Happy Homes, Phase 1 project in Shameerpet to be listed as a defaulter due to non-compliance with legal obligations.
Buyers who invested between 2020 and 2023 reported multiple complaints against the developer. Despite substantial payments made by buyers, there was little progress in the construction and promised approvals were not provided.
Legal Violations and Consequences
The authority highlighted that the developer operated without necessary project registrations under the RERA Act, which is a violation of the law. The developer was found to have collected funds without obtaining the required registrations.
In addition to penalties, the developer was instructed to refund buyers at an annual interest rate of 11% within 90 days of the order. The order also declared the developer as a ‘defaulter’ and prohibited them from conducting any real estate activities until all dues are settled.
Precautions for Homebuyers
Legal experts advise homebuyers to verify RERA registration for projects and visit sites in person to ensure construction progress. They should also have all documents vetted by independent legal experts to avoid potential liabilities.
Furthermore, buyers are urged to ensure that payments are made into project-specific escrow accounts to safeguard their investments.
