Supreme Court Agrees to Hear Urgent Plea

The Supreme Court has agreed to urgently hear a petition seeking to stay the execution of Indian nurse Nimisha Priya in Yemen. The petition was filed by the “Save Nimisha Priya Action Council”, requesting the Centre’s help to negotiate her release through diplomatic channels.

Background of the Case

Nimisha Priya, an Indian nurse from Kerala, was sentenced to death for the murder of Yemeni national Talal Abdo Mahdi in 2017. The petition highlights that she went to Yemen for employment but faced abuse and torture from Mahdi. The petition seeks judicial intervention to save Nimisha Priya’s life.

Legal Proceedings and Interventions

Senior Advocate R Basanth made an urgent mention before the Supreme Court against Nimisha Priya’s scheduled execution on July 16. The court issued a notice to the Attorney General, seeking the Centre’s reply on the matter. Justice Sudhanshu Dhulia and Justice Joymalya Bagchi heard the plea for urgent listing of the case.

According to Sharia law, negotiations can be held for the release of a person if the victims’ relatives agree to accept “blood money”. The “Save Nimisha Priya International Action Council” urged the Centre to facilitate negotiations with the victim’s family to pay the blood money.

High Court’s Decision

In 2022, the high court refused to order the Centre to negotiate the blood money but instructed legal measures against Nimisha Priya’s conviction. The Council continues to advocate for her release through legal and diplomatic means.
