Supreme Court Directs Delhi High Court to Hear Pleas on “Udaipur Files – Kanhaiya Lal Tailor Murder”

The Supreme Court has instructed the Delhi High Court to hear the pleas challenging the Centre’s approval for the release of “Udaipur Files – Kanhaiya Lal Tailor Murder” on July 28.

Details of the Case

The filmmakers, in their appeal against the high court’s stay order on the release, accepted the Centre’s clearance with six cuts and modifications in the disclaimer. The Supreme Court bench clarified that it has not given any opinion on the merit of the case, leaving it for the high court to decide the release issue.

Legal Proceedings

Jamiat Ulema-i-Hind president Maulana Arshad Madani and the accused Mohd Javed have been advised to approach the high court against the Centre’s decision. The high court had earlier halted the film’s release based on a plea by Madani, citing the powers under the Cinematograph Act.

Background of the Murder

Kanhaiya Lal, a tailor from Udaipur, was tragically murdered in June 2022 by Mohammad Riyaz and Mohammad Ghous. The assailants justified the act as a response to the tailor’s social media post supporting Nupur Sharma, a former BJP member.

NIA Investigation and Trial

The National Investigation Agency (NIA) looked into the case, leading to the accused being charged under the Unlawful Activities Prevention Act along with IPC sections. The trial is currently ongoing in a special NIA court in Jaipur.
